These Terms of Service apply to purchases made through Ikelite-Europe, operated by FOTOGRAFIT in Denmark. By placing an order with Ikelite-Europe, you agree to the terms described below together with our Shipping Policy and Refund & Return Policy.

Prices shown for deliveries within Denmark and the European Union include applicable VAT unless otherwise stated.

For qualifying deliveries outside the European Union, Danish/EU VAT is normally deducted where applicable.

Local VAT, customs duties, import fees and carrier handling charges may apply in the destination country and are normally the responsibility of the recipient.

In the event of an obvious pricing error, typographical error or system error, Ikelite-Europe / FOTOGRAFIT reserves the right to correct the error or cancel the affected order.

Offers and quotations

Unless otherwise stated, quotations and individual offers are valid for a limited period.

Prices in an offer may be adjusted if a manufacturer changes its pricing, exchange rates change materially, or an obvious pricing or calculation error has occurred.

Formation of contract

An order placed through the Ikelite-Europe website constitutes an offer from the customer to purchase the selected products.

The automated order confirmation sent by email confirms that we have received your order. It does not necessarily constitute final acceptance of the order.

A binding agreement is normally concluded when the ordered goods are dispatched and a shipping confirmation has been sent.

Product availability shown on the website is provided in good faith but may change without notice.

Products may become unavailable because of supplier delays, discontinued products, stock discrepancies or other circumstances outside our reasonable control.

If we are unable to supply an ordered product, we will contact you and, where applicable, refund any payment relating to the unavailable product.

For card payments, the amount will normally only be captured when the goods are dispatched, subject to the payment provider and applicable payment rules.

Payment processing does not prevent us from correcting an obvious pricing, technical or system error.

Companies and institutions may, where available and approved, purchase by invoice.

Statutory Rights & Complaints

Consumers have a two-year statutory right to make a complaint regarding defects in accordance with applicable consumer law.

A complaint must be made within a reasonable time after the defect has been discovered.

If the complaint is justified, we will provide the remedy required by applicable law. Depending on the circumstances, this may include repair, replacement, price reduction or refund.

Underwater equipment

Underwater Equipment

Underwater photographic equipment requires correct assembly, inspection, maintenance and operation by the user.

Once equipment has been used in water, factors such as water pressure, incorrect assembly, contamination, damaged sealing surfaces, O-ring condition, insufficient maintenance and operation beyond the manufacturer's specifications may affect its performance.

The user is responsible for following the manufacturer's instructions, checking sealing surfaces and O-rings, correctly installing ports, covers and accessories, and respecting the manufacturer's stated depth ratings and operating limitations.

Where appropriate, we recommend testing underwater equipment without valuable camera equipment installed before first use and after servicing, transport or major reassembly.

Water intrusion

Water Intrusion & Associated Equipment

No underwater housing or related underwater product can be guaranteed against water intrusion under all circumstances.

Unless required otherwise by applicable law, Ikelite-Europe / FOTOGRAFIT is responsible for the products supplied by us, but not for consequential damage to separate equipment used together with those products.

This may include cameras, lenses, phones, memory cards, batteries, lighting equipment or other accessories installed in or used together with underwater equipment.

Nothing in these Terms limits any rights or liability that cannot legally be excluded or limited under applicable consumer law.

Manufacturer warranty

Manufacturer Warranty

Some products may also be covered by a manufacturer's warranty.

Manufacturer warranties are provided according to the individual manufacturer's terms and may require inspection, repair or replacement through the manufacturer or an authorised service centre.

A manufacturer's warranty is separate from your statutory consumer rights.

Limitation of liability

Ikelite-Europe / FOTOGRAFIT cannot be held responsible beyond what follows from applicable law.

To the extent permitted by law, we are not responsible for indirect or consequential losses resulting from product failure, delayed delivery or inability to use equipment.

This may include loss of recorded images or video, loss of use, travel expenses, lost income, production delays or other indirect financial loss.

Force majeure

Ikelite-Europe / FOTOGRAFIT is not responsible for delays or failure to fulfil an obligation where this is caused by circumstances outside our reasonable control.

This may include natural disasters, war, civil unrest, labour disputes, transport disruption, government action, supplier failure, shortages, carrier disruption or other comparable events.

Business customers

Business Customers – B2B

Purchases made by companies, institutions, dive centres, professional photographers, production companies, universities, NGOs or other commercial organisations may be treated as business-to-business transactions.

Purchases made under a company name, VAT number or primarily for professional or commercial purposes may also be treated as B2B purchases.

Business purchases are not covered by all consumer protection provisions that apply to private consumers.

Unless otherwise agreed in writing, business customers normally receive a 12-month warranty covering manufacturing defects.

The B2B warranty does not normally cover normal wear, consumables, batteries, O-rings, seals, corrosion, improper maintenance, misuse, impact damage or water intrusion caused by incorrect assembly, maintenance or operation.

For B2B purchases, Ikelite-Europe / FOTOGRAFIT shall, to the extent permitted by law, not be liable for indirect or consequential losses including loss of use, loss of income, production delays or loss of recorded images or video.
